1. Introduction
These Terms of Use (hereinafter, "Terms") govern access to and use of the Zeus Web cloud monitoring service (hereinafter, the "Service"), offered by Microcom Sistemas Modulares, S.L.U., with registered address at Calle Gorostiaga 53, 20305 Irún (Guipúzcoa), Spain (hereinafter, "Microcom").The Service allows the collection, transmission, and display of operational data obtained from IoT devices manufactured by Microcom and located on the User's premises (hereinafter, "IoT Devices").
By using the Service, the User accepts these Terms in their entirety. If you do not agree with them, you must refrain from using the Service.
2. Definitions
• User: Natural or legal person using the Service.• Personal Data: Any information relating to an identified or identifiable natural person.
• Operational Data: Information generated by IoT Devices related to the User's processes.
• IoT Device: Physical equipment manufactured by Microcom that collects and transmits data for processing by the Service.
3. Service Description
Zeus Web allows the User to monitor their facilities in real time and historically by processing data captured by IoT Devices. This data includes parameters such as level, pressure, flow rate, temperature, among others, as well as the performance of the IoT Device.4. Access to the Service
To access the Service, the User must have at least one compatible IoT Device, complete the registration process, and accept these terms. Microcom may deny or suspend access in the event of non-compliance.5. Data Collection and Use
a) Personal Data: Collected in accordance with the General Data Protection Regulation (GDPR) and applicable Spanish regulations. It includes contact information, credentials, and technical information necessary for the operation of the Service.b) Operational Data: Includes functional data of the IoT Device and the User's facilities. Microcom may process such data as a data processor, unless otherwise expressly agreed. Where appropriate, data processing on behalf of the User will be regulated by the corresponding contract in accordance with Article 28 of the GDPR.
6. Data Retention
Operational data will be retained for a maximum period of six (6) months, after which it will be automatically deleted. The User is responsible for making any backup copies it deems necessary.7. User Obligations
The User agrees to:• Maintain the confidentiality of their credentials.
• Use the Service in accordance with applicable law.
• Inform Microcom of any security incidents.
8. Intellectual Property
All rights to the software, design, content, and documentation of the Service belong to Microcom. The User is granted a limited, non-exclusive, and revocable license to use the Service in accordance with these rights.9. Data Protection and Privacy
The processing of personal data will be governed by Microcom's Privacy Policy, accessible at [https://www.microcom360.com/politica-privacidad]. The User may exercise their rights of access, rectification, erasure, objection, restriction of processing, and portability by sending a request to [microcom@microcom.es].10. Limitation of Liability
Microcom does not guarantee the continuous availability of the Service or the absence of errors. It shall not be liable for indirect damages, loss of data, or loss of profits. This limitation does not affect the consumer's rights recognized by law.Microcom shall not be liable for failures or interruptions of the Service resulting from force majeure, including natural disasters, widespread network failures, acts of government authorities, or cyberattacks.
11. Modification of the Terms
Microcom may modify these Terms by notifying the User in advance through the Service itself, by email, or by any other means of contact provided by the User during registration. Continued use of the Service after the changes will imply acceptance.12. Termination
Microcom may suspend or terminate access to the Service in the event of non-compliance, without prior notice. The User must cease using the Service and delete any stored data upon termination.13. Reasonable Use of the Service
In order to ensure the stability and performance of the Service for all Users, Microcom establishes the following reasonable usage thresholds related to the frequency of data sending, number of historical records, alarm events, and connection frequency of IoT Devices:• Maximum daily records per device: 100,000
• Maximum daily connections per device: 300
• Maximum daily alarm events per device: 250
Microcom reserves the right to modify the configuration of an IoT Device that consistently exceeds the established reasonable usage limits. The User will be notified of such modification at least five (5) business days in advance, except in cases where there is a risk to system stability, in which case immediate action may be taken with subsequent notification.
In cases of serious or repeated non-compliance, Microcom may suspend the IoT Device's access to the Service, temporarily or permanently, without the right to compensation, after providing reasonable notice to the User.
